San José, CA — A legal dispute over the control and future of the Viet Museum has escalated into a lawsuit filed in Santa Clara County Superior Court, highlighting tensions between a nonprofit organization and the entity managing the historic site where the museum is located.

The lawsuit was filed by Immigrant Resettlement & Cultural Center, Inc. (IRCC), a nonprofit that has operated the Viet Museum for more than four decades. The defendant, History San José (HSJ), is the nonprofit contracted by the City of San José to manage the historic park property where the museum sits.

Dispute over authority and governance

According to the complaint, IRCC alleges that HSJ improperly intervened in the organization’s internal leadership disputes—something IRCC argues HSJ has no legal authority to do.

However, the museum temporarily reopened from February 14 to February 22, 2026, during Lunar New Year (Tết). The complaint states that the reopening was orderly, safe, and without incident, suggesting that continued closure may not be necessary.

Concerns over potential reassignment

A major point of contention in the lawsuit is HSJ’s alleged plan to terminate IRCC’s role and potentially issue a Request for Proposals (RFP) to assign a new operator for the Viet Museum.

IRCC argues that such a move, if carried out before the court resolves the governance dispute, could cause irreversible harm—both to the organization and to the museum’s mission of preserving Vietnamese refugee history.
