A San Jose family has filed a lawsuit against a major funeral services company after a horrifying series of events—beginning with a father emptying what he believed were his son’s clothes into a washing machine, only to discover human brain matter splashing into the drum.

According to a newly filed complaint in Santa Clara County Superior Court, the family of Alexander Elias Pinon, who died in May 2025, had asked the funeral home to return the clothing he was wearing at the time of his passing. Instead, the funeral director allegedly handed them a red biohazard bag, assuring them it contained only clothing.

When Alexander’s father, Raymundo Llanes, arrived home, he opened the washing machine and dumped the entire contents of the bag inside to avoid touching the soiled items. Moments later, he realized there were no clothes—only his son’s brain inside the machine.

Shocked and panicked, he scooped the brain matter out of the washer and placed it back into the red biohazard bag. He was not yet aware that the Coroner had performed a cranial autopsy, nor that his son’s brain had been removed.

Months-long concealment

The lawsuit alleges the funeral director, identified as Annette “Anita” Singh, retrieved the bag but never explained what happened. Over the next two months, the family repeatedly texted her asking for the son’s clothing, receiving vague promises that she would “check” or “call tomorrow.”

Behind the scenes, the complaint states, Singh hid the box containing the brain in an outdoor courtyard, where it remained unsecured for 2.5 months during summer heat.

Employees eventually opened the deteriorating box and discovered inside multiple bags containing what they described as a decomposed, clay-like human brain—later confirmed to be Alexander’s.

The family says they were not informed until late August, months after the burial, that their son’s brain was never placed back into the casket and remained at the funeral home.

Claims of negligence, fraud, emotional distress

The complaint lists numerous causes of action, including negligence, intentional infliction of emotional distress, fraud, and breach of contract, alleging:

The funeral home misrepresented the contents of the bag.
The father endured the trauma of discovering and physically handling his son’s brain.
The funeral home hid the brain, allowed it to rot, and failed to disclose its whereabouts.
The family’s repeated requests were ignored for weeks.
To this day, according to the lawsuit, the funeral home still possesses the brain and the clothing.document (28)

The family seeks compensatory and punitive damages, along with a court order requiring the funeral home to return the brain so it may be buried properly.

Theo đơn kiện, ngày 4 tháng 6, 2025, người cha là Raymundo Llanes đến nhà quàn để nhận lại quần áo con mình mặc lúc qua đời. Nữ giám đốc nhà quàn, Annette “Anita” Singh, trao cho ông một túi đỏ biohazard, khẳng định bên trong chỉ là quần áo.

Về đến nhà, ông mở máy giặt và đổ toàn bộ túi vào bên trong để khỏi phải chạm tay vào đồ bẩn. Ngay sau đó, ông choáng váng khi nhận ra không có quần áo nào cả — chỉ có mô não của con trai. Ông buộc phải tự tay vớt từng phần não khỏi máy giặt, cho lại vào túi. Lúc đó gia đình vẫn không hề biết con mình đã bị mổ sọ khi khám nghiệm tử thi.

Bộ não bị giấu ngoài trời suốt 2.5 tháng

Đơn kiện cho biết sau khi lấy lại túi, nhà quàn không giải thích gì, không trả lại quần áo, và liên tục trì hoãn trả lời mỗi khi gia đình nhắn tin hỏi.

Nghiêm trọng hơn, bà Singh bị cáo buộc đã giấu thùng đựng bộ não trong sân sau của nhà quàn, ngoài trời, suốt hơn 2 tháng mùa hè. Khi nhân viên nhà quàn mở thùng ra, họ thấy nhiều lớp túi, và bên trong là não người đã phân hủy, đổi màu, bốc mùi nặng — sau đó xác nhận là của Alexander.

Gia đình chỉ được thông báo vào cuối tháng 8, tức là sau lễ tang, rằng bộ não của con họ không hề được đặt lại trong quan tài và vẫn nằm tại nhà quàn.

Cáo buộc: tắc trách, gian dối, gây tổn thương tinh thần nghiêm trọng

Đơn kiện cáo buộc nhà quàn:

Nói dối về nội dung túi đồ.
Khiến người cha phải tận tay chạm vào não con mình khi dọn máy giặt.
Giấu bộ não hơn 2 tháng, để nó phân hủy ngoài trời.
Không trả lời tin nhắn, không giải trình.

Gia đình yêu cầu bồi thường thiệt hại và muốn tòa buộc nhà quàn phải giao trả bộ não để chôn cùng thi thể, nhằm đem lại sự an nghỉ cuối cùng cho Alexander.
